What information we may collect and why:

Information you provide – When you contact us, we ask for your personal information (including health related information) to take steps providing you with services or products you are interested in.  Some information you explicitly provide to us, other information me automatically collect.

We may combine the information you submit to third parties to provide you with a better experience and to improve the quality of our services.

We always give you the opportunity to opt out of sharing or using information to the extent possible without restricting the quality of your services.

Cookies – When you visit Live Oak Detox web pages, we send one or more cookies to your computer or other device.  We use cookies to improve the quality of our service, including saving your user preferences, improving search results and ads that you see.

Affiliated Google Services on other sites – We offer some of our services on or through other web sites with their own privacy policies. Personal information that you provide to those sites may be sent to Google to deliver the service to you. We process such information under this Privacy Policy.

Third Party Applications and Sites – Live Oak Detox may make available third-party applications, such as gadgets or extensions, through its services to enhance your experience with us.  Information collected by the third-party application provider is governed by their respective privacy policies.  This Privacy Policy applies only to Live Oak Detox services.  Please refer to the respective privacy policies of those sites as they may place their own cookies or other files on your computer, collect data or solicit personal information from you.

Live Oak Detox uses the Google and Yahoo retargeting advertising cookies on AdSense partner sites and certain other services to help advertisers and publishers serve and manage ads across the web. You can view and manage your ads preferences associated with this cookie.

In accordance with HIPAA, HITECH, Privacy Shield and other applicable laws, Live Oak Detox only shares information only with other companies or individuals outside of Live Oak Detox in the following limited circumstances:

We have your consent. We require opt-out consent to refrain from sharing of any sensitive personal information.

We provide such information to our subsidiaries, affiliated companies or other trusted businesses or persons for the purpose of processing personal information on our behalf. We have a good faith belief that access, use, preservation or disclosure of such information is reasonably necessary to (a) satisfy any applicable law, regulation, legal process or enforceable governmental request, (b) provide you with the services, (c) enforce applicable terms of service, including investigation of potential violations thereof, (d) detect, prevent, or otherwise address fraud, security or technical issues, or (e) protect against harm to the rights, property or safety of Live Oak Detox, its users or the public as required or permitted by law.

Location Data – Live Oak Detox offers location-enabled services (such as GPS signals sent by a mobile device) or information that can be used to approximate a location (such as a cell ID or IP address).  We analyze IP addresses in aggregate for system administration purposes and to gather broad demographic information.  We may share this information with the financial institution that issued the credit card with which an order was placed or with law enforcement authorities if we determine, or are notified that the use of the credit card was fraudulent.

Protected health information and other sensitive Information you have provided us or we may have access to:

Your protected health information or sensitive health information may be used by staff members or disclosed to other health care professionals, who need to know, for the purpose of evaluating your health, diagnosing medical conditions, and providing treatment. Live Oak Detox abides by HIPAA and HITECH Act protecting your information while providing you with the services you are seeking.

For example, results of laboratory tests and procedures will be available in your medical record to all health professionals who may provide treatment or who may be consulted by staff members.

In accordance with HIPAA and HITECH Act, your health information may also be used to support the day-to-day operations and management of Live Oak Detox , including improvement of our services and development of new services.

Required reporting. If required, to remain compliant with HIPAA and HITECH Act, your protected health information may also be disclosed:

To law enforcement agencies, without your permission, to support government audits and inspections, to facilitate law-enforcement investigations, and to comply with government mandated reporting.

For court order compliance(s)

To public health agencies as required by law. For example, we are required to report certain communicable diseases to the state’s public health department. Also, we are required to disclose PHI to the Secretary of the U.S. Department of Health and Human Services when the Secretary is investigating or determining our compliance with the HIPAA Privacy Rules.

Payment. Your protected health information may be used to seek payment from your insurance company(s) (health, dental, auto, or other) and from any other source that you identified that you may use to pay for services such as credit card, cashier check, personal check and or banking company(s).  This is part of the way we are able to provide you with services and is completely within the HIPAA and HITECH Act requirements.

For example, your health plan may request and receive information on dates of service, the services provided, and the medical condition being treated.

Other uses and disclosures of your information require your authorization.  Under the requirements of HIPAA, the disclosure of your protected health information or its use for any purpose other than those listed above requires your specific written authorization. If you change your mind after authorizing a use or disclosure of your information you may submit a written revocation of the authorization. If the information that we have contains an error or is inaccurate, you have the right to correct it.  If you or your representative authorize us to use or disclose your health information, you may revoke that authorization in writing at any time to stop future uses or disclosures.  Your revocation will not affect any use or disclosures permitted by your authorization while it was in effect.

Where do we process your information?

Live Oak Detox processes personal information including protected health information on our servers in the United States of America.

Information security:

We take necessary security measures to protect against unauthorized access to or unauthorized alteration, disclosure, or destruction of data.  These include internal reviews of our data collection, storage and processing practices and security measures, including data encryption, administrative and physical security measures to guard against unauthorized access to systems where we store personal data.

We restrict access to personal including protected health information to Live Oak Detox employees, contractors and agents who need to know that information to provide you the services you are seeking out on our behalf.  These individuals are bound by confidentiality obligations and may be subject to discipline, including termination and criminal prosecution, if they fail to meet these obligations.

Accessing, controlling and keeping personal information including protected health information:

When you use, Live Oak Detox services, we make good faith efforts to provide you with access to your personal information and either to correct this data if it is inaccurate or to delete such data at your request if it is not otherwise required to be retained by law or for legitimate business purposes.

We ask individual users to identify themselves and the information requested to be accessed, corrected or removed before processing such requests.

In any case where we provide information access and correction, we perform this service free of charge. Because of the way we maintain certain services, after you delete your information, residual copies may take a period of time before they are deleted from our active servers and may remain in our backup systems. You have certain rights under the federal and state privacy standards such as HIPAA, HITECH Act, CCPA and other data privacy laws such as state level Consumer Protection Acts and Privacy Acts. These include:

Enforcement:

Live Oak Detox regularly reviews its compliance with this Privacy Policy and all applicable laws and regulations, including HIPAA, HITECH.  When we receive written requests or complaints, it is the Live Oak Detox policy to timely contact the concerned user regarding his or her concerns.   We will cooperate with the applicable law and regulatory authorities, including the FTC and other federal, state, and local data protection authorities, to resolve any complaints regarding the transfer of personal data that cannot be resolved between Live Oak Detox and an individual.
